Dukhu Ram says the king is naked.

This small bit of news in my local Indore newspaper caught my attention early this morning. With a mix of laughter and sorrow, I read it again and again, and fell into deep thought.

Let's see the news, in original, first. Here it is -

Assuming what this news says is authentic and true -

Imagine.. an innocent village-dweller, being forced to attend court-proceedings for SIX LONG YEARS and no end to the torture in sight.. imagine his plight. His capital, whatever little it may be, is getting eroded and he may be on the brink of bankruptcy.

The innocent villager seeks wise advise from someone who with all his sagacity gathered over the years recommends greasing the wheels of the machinery to get it moving fast. Unfortunatly, the modus operandi of greasing is left unexplained! And lo - Dukhu Ram places the dough right on the Judge Saab's table in full public view - because that's what the wise man has advised him to do!

'Justice delayed is justice denied'. By this yardstick, a huge majority has tasted the fruit of denial for a long time, in the Indian judicial system. Imagine the plight of villagers with little resources, little education and virtually zero legal understanding. Forced to undergo the experience of fighting legal battles that are dotted with slow processes, expensive lawyers, repeated adjournments/postponements and the associated mental and emotional torture, millions get brutally grinded in this system.

Our Union Law Ministers for many years have acknowledged this and repeatedly promised to reform the whole system - nothing much has happened so far. At least nothing for people like Dukhu Ram.

I liken Dukhu Ram, the brave and innocent Dukhu Ram, to the proverbial child who told the king - when all others were praising his heavenly sartorial taste - that he was actually standing naked and the praises being showered by others were out of sheer fear of offending his majesty. In his innocence, Dukhu Ram unitentionally ended up doing what perhaps millions would have desired to, but did not, over the years!

So, dear reader, the verdict is simple - for being so innocent, for failing to understand the ways of the State machinery, for demanding quick justice that's actually his human right, and for being so forthright, Dukhu Ram deserves nothing but the death penalty. For the system is not likely to appreciate what he did, and incorporate the learning to improve itself drastically. The system is far too big, and far too ossified for anything so innocent to leave any impact.

We may criticise the Chinese for ruling by law, and pat our backs for having a rule of law, but the stark reality at the bottom of the pyramid leaves senses stunned.

Death to Dukhu Ram. Long live Dukhu Ram.

The real face of our judicial machinery is out! So sad :-(
Lots of rural Indians are innocent. But we, the Facebook users, are not. We can be the observers to this incidence or we can do a bit for this Dukhu Ram. What i can do is that i will start posting this blog where ever possible on net. May be this can help this poor little Dukhu Ram get blessings to get the judgement ASAP. No other ways it's possible. God bless!

Couldn’t agree more! Wondering if the anti corruption bureau,CG has read this article and will take action against the judge. This is just one of the many cases. Also feel that either there should be local ACG offices /agencies that could be directly approached by the localities or different channels that are involved are intact and in place. Also frequent raids should be conducted so that people have this fear that they are under vigilance and if caught the punishment will be severe. And the most important thing is, the common man saying ‘NO’ to corruption.

Dear Sir,

Very rightly put up ..

When it comes to judiciary, we have no "discovery" process of speedier implementation.
nodoubt the judicial system is highly biased, expensive and always a dream for poor people...An ordinary man cannot waste his money and time running case which would proceed throughout his life time and sometimes beyond it.Now its corruption that's haunting trial courts ...

The Government should review the judicial system ...setting up a few fast track courts and mobile courts will not solve the problem ...the entire system should be changed for fast track justice ....and the cost of running cases need to be reviewed...rightly said "Justice delayed is always justice denied."

There should be LAW or Rule that the case can not be postponed beyond three/four times.
What ever the current blocks..status failure of judiciary is the first and most important is that comman man is not getting justice and is being embroiled.

regards.

Respected Sir,
You mentioned our bragging too much on India following a rule of law. But in reality the democratization of lot of things has not happened yet. There is only one thing where everyone has equality, or where pure(90%) democratizaion has happened i.e election process, because that serves the purpose of politicians. Except this process there is no area, atleast in my knowledge, where democratization has purely happened. And this rule of law of ours is a hollow system, it confuses unprivileged people; who are shown a false-picture of democratization.
Yours sincerely,
Avinash Choudhary

Dear Sir,

This was the next blog I read after reading "China's Nobel nightmare, and lessons for India". I must say Dukhu Ram is actually the grey reality of the system. We can never claim China to be all black & India to be all white or vice versa, both systems have shades of grey. But then again, only God could save Dukhu Ram if he were a chinese :-)
